“Turner” (not a real person) loved to paint. Along with his son, he had owned and operated a thriving painting business for fifteen years, winning praise from his clients for his fine handiwork and fair prices. When a local supermarket changed ownership, Turner and his son got the call to repaint the exterior in a color more suitable for the new brand.
The one point of the deal that made Turner uneasy revolved around who would construct the scaffolding for the job. Turner had a preferred provider he typically used for such jobs, but the store’s owner had already contracted another company, one with which Turner was unfamiliar. He resolved to be extra careful.
For the first day of the job, everything went smoothly. The second day was windier, though Turner thought he still could work safely, ten feet above the ground on the scaffolding. He was proven wrong, though, when a wind gust knocked him off balance. The sudden shift of his weight was too much for the scaffolding to handle. It gave way, sending Turner plunging down to the hard pavement below.
Turner suffered a dislocated shoulder and broken clavicle. Though the store offered to pay him for his work, he knew the injury would impact him beyond this one job. He had several other jobs lined up over the next few weeks that he was now going to miss, or have his son try and do alone – and that wasn’t even taking his medical bills into account.
The store’s owner balked at providing Turner any additional compensation. It claimed that the company that set up the scaffolding was to blame for its failures. But the scaffolding company claimed it was the responsibility of the store to inspect it.
After going round and round with the two companies to no avail, Turner called a personal injury attorney for help. The attorney filed a lawsuit but said it was going to take time to work its way through the courts; in the meantime, Turner’s bills were piling up and he was missing work. That was when his lawyer suggested he contact USClaims to secure much-needed pre-settlement funding.
